Min fee of the issued quote is payable in Advance (unless an existing account holder).
Printing Fees
Printing fees can vary depending on area and state, ranging from $0.275c to $0.55c per page for B&W.
Conduct Money — Subpoenas
Any Conduct Money with a Subpoena must be paid with the instructions. This cheque is to be payable to the required Witness (Not Nautilus).
Standard (Non-Urgent) Fees
Fees quoted are based on NON URGENT with sufficient time (min 7 days after receipt for the attempt) to complete service, affidavit and return by standard mail.
Urgent Service
Urgent fees are charged if you need attendance / service in less than 7 days. URGENT documents will incur an additional fee — if service or attendance is required in less than 7 days you must advise Citiserve of this urgency. Agent will normally make an attempt within 5 business days, however if you must have urgent attendance and reports within this period, it will be classified as 'urgent'. Urgent fees in general are an additional 50% minimal fee.
Third Party Broker
Our office acts as a third party (broker) for the service of your document, and issues the documentation to a fully licensed process server (applicable to their state if required). Noting some states in Australia do not require a licence to serve a document.
Fees Per Address & Per Defendant
Fees are payable PER ADDRESS and PER DEFENDANT unless otherwise agreed by our office. If documents are served at the same time only a nominal fee is charged for additional defendant (from $55.00, and excludes printing or multiple attempts).
Address Accuracy
It is your responsibility to ensure the address is accurate and correct. Unfortunately, our agent is unable to verify an address should occupants deny who they are or refuse to answer questions. Photos are helpful but unfortunately are not always accurate. Agents do their best in identification but cannot guarantee service.
Re-Attendance After Failed Attempt
If after an attempt, the documentation is not served, but you believe that they are the actual occupants, our agent can reattend at no charge (if within the number of attempts you have paid for). Your instructions will need to be in writing. We will also ask that you provide factual evidence supporting the fact that the respondent/s still live at the address. This will assist our agent in enquiries. We cannot simply attend questioning the same occupants without some sort of confirmation, as this could be deemed as harassment to the other party. Unfortunately, simply stating "I know he lives there" or similar is not sufficient. If some additional evidence is available we can attend. Again, the process server is unable to guarantee service of any document. If the occupants still continue to provide false information, you can seek orders from the court for substituted service, but you will need to prove to the court in the same way that the defendant does reside at the address.
Affidavit Fees & Return
Additional fees are payable prior to the return of any affidavit (unless an account holder). As we are in the age of electronic lodgement, original affidavits will not be returned unless you specifically ask for the affidavit (additional costs for the return may be payable). If affidavits are returned they are returned by standard ordinary post. If you require a more secure return, you can request an express post return. A fee of $20.00 in most cases will apply (plus any printing for annexures).
Document Responsibility
Documents and legality of the documents is the sole responsibility of the issuer i.e.: Solicitor, Plaintiff and/or its Collection Agent etc. We accept no responsibility for incomplete, inaccurate, or any errors in documents. This includes Form 1–4 which may be applicable for interstate services.
Strictly No Refund
STRICTLY NO REFUND — once the file is issued from our office and is given to our agent, the fee is incurred.
Agent Conduct & Safety
Our agent will NOT under any circumstance knowingly break the law, this includes any harassment of the defendant or occupants. Our agent will NOT under any circumstance place themselves in danger to serve a document. If you or your client has any knowledge of possible danger to our agent, it is your obligation to advise our office with instructions. If the document cannot be served due to a threat of violence, or the area is too dangerous to travel in, the agent will attempt to seek instructions from our office for alternative service. It is the client's responsibility to ensure all information is provided to our office, including but not limited to any previous acts or threats of violence or threats to the Applicant/Plaintiff. Failure to provide this information may result in action being taken against you for any damages incurred.
Number of Attempts
Our agent will make every effort to serve the required documentation, however we are unable to make any guarantee. Affidavits of attempt will be provided if required. The fee will normally cover up to 3 attempts in local areas, 3 attempts in capital cities interstate and 2–3 in country areas. Remote areas however may be charged per visit — this will be advised in your quote.
Acceptance of Terms
By forwarding documentation to our office, you accept all terms and conditions and costs. Fees are subject to change without notice.
Account Holders
Account Holders — Invoices are payable within 14 days of month end statements. Payments not received within 30 days of month end, an administration fee of $11.00 per invoice, per month may be charged. This is at the discretion of our firm. Payments exceeding 90 days will result in these fees being charged per month / per invoice.
